Mr. Papa is a highly experienced (over 40 years) trial attorney who has represented both plaintiffs and defendants in State and Federal Court throughout California as well as Oregon, Hawaii, Nevada, Nebraska and Washington.

His early practice included a broad range of cases with emphasis on litigation in the areas of personal injury, landlord-tenant disputes, family law matters of divorce, child custody, support and property distribution, partnership and small business dissolution and real estate contract litigation. Practice during this stage also included performing artist contract litigation and labor-management disputes over wages and hours.

Subsequently, Mr. Papa was appointed to the City Attorney’s Office in San Francisco. He represented the City in civil litigation matters involving governmental entity liability for operation of the Municipal Railway, public streets, parks and playgrounds, school property, police conduct and firefighter performance.

Assignment to the City Attorney’s Office included condemnation cases, legislative representation at the State Capitol, regulatory agency hearings, administrative law hearings and Juvenile Court proceedings related to custody and adoption of abandoned children.

Upon return to private practice, Mr. Papa was recruited by a large litigation firm emphasizing plaintiff’s personal injury practice representing clients in both Federal and State Court throughout California and in foreign states.
Over the subsequent years until this present date, Mr. Papa accumulated extensive experience compiling evidence and trying cases to juries in matters involving cases brought under the Jones Act and General Maritime Laws for injured sea workers and under the Federal Employers Liability Act for injured railroad workers. These cases were tried in both Federal and State Court. A significant number of cases related to ship board and dock side injuries incurred by longshoreman and harbor workers.

Additionally, Mr. Papa compiled extensive success for his clients preparing and trying cases based upon manufacturer’s liability and product design defect where dangerous design of products resulted in catastrophic burn injuries and numerous forms of lifetime disability.

Mr Papa’s ensuing years of trial work included numerous cases against governmental transit agencies serving the Bay Area. Many of the cases were brought against governmental agencies throughout the greater Bay Area for dangerous condition of public property, highway and road design defect, employee negligence in school and recreational activities, playground safety and athletic equipment failure.

Mr. Papa achieved a high success rate for clients in premises liability cases for dangerous design characteristics, dangerous materials, negligent maintenance, code violations, catastrophic fire, stairway collapse, balcony failure and toxic contamination. Many of these cases included issues of insurance coverage and punitive damages for bad faith refusal to pay insurance coverage limits.

Mr. Papa achieved almost countless favorable verdicts for clients in motor vehicle accident cases over the years. The cases were presented to juries in more than a dozen different jurisdictions throughout California and in Nebraska and Oregon. The cases involved automobiles, emergency vehicles, lumber hauling trucks, fuel trucks, motor homes and cranes.
Many of these cases involved detailed analysis and expert opinion on motorcycle design and motorcycle operation dangers. Additionally, a good number of the cases involved issues of punitive damages for insurance bad faith refusal to pay policy coverage limits.

Mr. Papa has also had considerable experience in cases of professional negligence, as attorney for plaintiffs seeking damages for medical negligence and dental negligence. He has served as both party arbitrator and neutral arbitrator on medical negligence claims against Kaiser Permanente Medical Group.

Mr. Papa has an accumulation of successful case results from his considerable experience in construction defect cases. The cases have involved collapsing scaffold, dangerous flooring, safety code violations, unsafe job site practices, dangerous rolling equipment, negligent crane operation, collapsing trenches, collapsing side walls, dangerous walkways and negligent operation of motorized lift equipment.

The construction cases all involved multiple parties, multiple layers of insurance coverage, workers compensation liens and medical reimbursement liens. A number of these cases were successfully resolved by Mr. Papa through mediation.

Additionally, Mr. Papa has represented clients in wrongful death and catastrophic injuries arising out of aviation accidents. He has handled cases involving both general and commercial aviation equipment failure as well as flight operations error. Mr. Papa represented the interests of his clients in the courtroom as well as with FAA and CAB investigations and hearings. Mr. Papa’s aviation law experience includes acting as legal counsel and participating in management oversight for a scheduled commuter air carrier serving six Northern California cities.
